Welcome to Launch Point. These Terms and Conditions (“Terms”) govern your access to and use of the Launch Point website, accounts, profiles, travel-planning tools, community features, business listings, excursion listings, restaurant information, accommodation information, articles, reviews, Travel Journals, favorites, itineraries, and other features or services made available through the website.
Throughout these Terms, “Launch Point,” “we,” “our,” and “us” refer to Launch Point. “You” and “your” refer to any visitor, registered user, traveler, community member, business owner, excursion operator, restaurant representative, accommodation representative, or other person who accesses or uses the website.
Launch Point is based in Homer, Alaska and is designed to help visitors discover and explore through local travel information, adventures, excursions, accommodations, restaurants, articles, recommendations, community experiences, and trip-planning resources. The website may also allow registered users to create profiles, save favorites, build itineraries, publish Travel Journals, submit ratings or reviews, interact with community content, and access other features. Businesses and service providers may be able to register, submit information, and have their services or offerings displayed through the platform.
By accessing or using Launch Point, creating an account, submitting content, registering a business, or using any feature of the website, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the website or create an account.
1. Using Launch Point and Your Account
You may use Launch Point for lawful personal, travel-planning, community, informational, and legitimate business-related purposes consistent with the nature of the platform. Some features may be available to visitors without registration, while other features may require you to create an account.
When creating an account, you agree to provide information that is accurate, current, and complete to the best of your knowledge. You are responsible for keeping your account information reasonably up to date and for maintaining the confidentiality of your username, password, and other account credentials.
You are responsible for activities carried out through your account unless they occur because of circumstances for which you are not legally responsible. You should not share your login credentials with another person or allow someone to impersonate you through your account.
If you believe that your account has been compromised, accessed without authorization, or used improperly, you should contact us promptly at info@launchpoint.travel.
Launch Point may provide different account types or permissions, including visitor accounts and accounts intended for businesses, excursion providers, or other service providers. Certain features may therefore differ depending on the type or status of your account.
If you create or manage an account on behalf of a business, organization, excursion provider, restaurant, accommodation provider, or other entity, you represent that you are authorized to provide the submitted information and use the account on that entity’s behalf.
You may not create an account using false information, impersonate another person or organization, falsely claim an association with a business, create accounts for deceptive or abusive purposes, attempt to gain unauthorized access to another person’s account, or use Launch Point in a manner intended to mislead other users.
Launch Point is not directed to children under 13. If you are under the age of legal majority where you live, you should use features involving accounts, submissions, bookings, purchases, or other legally significant actions only with the involvement and permission of a parent or legal guardian.
We may establish, modify, suspend, or discontinue particular account features from time to time as the platform develops. We may also take reasonable steps to verify accounts, business submissions, listings, or other information where necessary for platform integrity or user safety.
Registration on Launch Point does not guarantee approval, publication, visibility, ranking, traffic, inquiries, bookings, sales, or any particular result.
2. Travel Information, Adventures, Excursions and Third-Party Services
Launch Point provides information intended to help people discover a love of the outdoors and explore available activities, adventures, excursions, restaurants, accommodations, local businesses, articles, itineraries, and other travel-related opportunities.
Travel information can change. Prices, operating hours, schedules, availability, seasonal access, trail conditions, road conditions, transportation, weather, policies, amenities, menus, accommodation features, excursion requirements, business information, wildlife conditions, booking terms, and other details may be changed by independent providers or affected by circumstances outside Launch Point’s control.
While we may review, organize, display, or update information available through the website, we do not guarantee that every listing or piece of information will always be complete, current, accurate, available, or appropriate for every individual.
Users should independently confirm important information directly with the relevant business, excursion operator, restaurant, accommodation provider, transportation provider, park authority, guide, or other responsible party before making travel arrangements or relying on information that may affect a trip.
Some Launch Point pages may provide links, contact options, inquiry features, booking opportunities, or other methods of connecting with independent businesses or service providers. Unless expressly stated otherwise for a particular service, those providers operate independently and are responsible for the services, products, experiences, accommodations, meals, transportation, bookings, cancellations, refunds, schedules, pricing, safety procedures, insurance, licenses, permits, representations, and other obligations associated with their businesses.
Your dealings with an independent provider may be subject to that provider’s own terms, cancellation policy, refund policy, privacy policy, waivers, eligibility requirements, safety rules, or other agreements. You should review those conditions before completing a booking, payment, reservation, or other transaction.
Launch Point may display recommendations, staff picks, featured listings, related adventures, popular content, editorial selections, reviews, ratings, or other forms of discovery. Unless explicitly stated otherwise, the appearance, placement, recommendation, popularity, rating, or inclusion of a business or activity on the website should not be interpreted as a guarantee regarding its quality, safety, suitability, availability, licensing, performance, or outcome.
Outdoor and travel activities can involve inherent risks. Hiking, fishing, boating, wildlife viewing, flightseeing, skiing, climbing, hunting, water activities, remote travel, winter activities, backcountry travel, and other adventures may involve changing weather, difficult terrain, wildlife, water conditions, equipment failure, transportation risks, physical exertion, limited communications, delayed emergency assistance, and other hazards.
You are responsible for assessing whether an activity is appropriate for you and the members of your party. You should consider your health, experience, fitness, equipment, weather conditions, local guidance, applicable regulations, safety recommendations, and the qualifications of any provider involved.
Information available through Launch Point is provided for travel planning and general informational purposes and is not a substitute for professional safety advice, emergency guidance, medical advice, official weather warnings, park regulations, or instructions provided by qualified guides or authorities.
Travel plans and itineraries generated, saved, suggested, published, or assembled through Launch Point should be treated as planning resources rather than guarantees that a route, activity, business, accommodation, restaurant, or excursion will be available or suitable when you travel.
3. Business Listings, User Content, Reviews and Community Features
Launch Point may allow users and businesses to submit, publish, upload, store, or share information and content. This may include business descriptions, excursion details, accommodation information, restaurant information, profile photographs, cover photographs, usernames, itinerary information, Travel Journals, stories, photographs, captions, reviews, ratings, comments, recommendations, and other contributions. We refer to these materials collectively as “User Content.”
You retain ownership of original User Content that you create, subject to any rights belonging to other parties. By submitting User Content to Launch Point, you give us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, resize, display, publish, distribute, and otherwise use that content as reasonably necessary to operate, promote, maintain, and provide Launch Point and the feature for which the content was submitted.
For example, if you upload photographs to a public Travel Journal, we need permission to display those photographs as part of your journal. If a business uploads photographs and descriptions for a public business listing, we need permission to display those materials to users discovering that business.
This license does not transfer ownership of your original content to Launch Point.
You are responsible for the User Content you submit. You represent that you have the necessary rights or permissions to submit that content and that its use as contemplated by the website will not knowingly violate another person’s intellectual-property rights, privacy rights, publicity rights, contractual rights, or other legal rights.
You should not upload photographs, documents, personal information, or other material belonging to another person unless you are authorized to do so.
Content submitted to public areas may be visible to other visitors and users. This includes public profiles, reviews, ratings, comments, business listings, Travel Journals, photographs, and similar features. Do not publish information you want to remain private.
Reviews and ratings should reflect genuine experiences and opinions. Users may not knowingly submit fake reviews, fabricated experiences, reviews intended to impersonate another customer, misleading ratings, or content designed to improperly manipulate a business’s rating or reputation. The FTC currently prohibits specified deceptive conduct involving consumer reviews and testimonials, including certain fake or false reviews.
Businesses should not attempt to manipulate Launch Point reviews through fake accounts, impersonation, undisclosed deceptive practices, threats, or other improper conduct.
Launch Point does not necessarily endorse opinions contained in reviews, Travel Journals, comments, user profiles, or other community contributions. Those materials generally reflect the views and experiences of the people who submitted them.
We may, but are not obligated to, review, moderate, restrict, refuse, edit, hide, or remove User Content when reasonably necessary to maintain the website, enforce these Terms, address complaints, protect users, investigate suspected abuse, comply with legal requirements, or maintain the quality and integrity of the community.
A business’s disagreement with a negative review does not by itself guarantee that the review will be removed. Similarly, publication of a review does not mean Launch Point has independently verified every statement contained in it.
Business owners are responsible for ensuring that information they submit about their businesses, excursions, services, schedules, pricing, facilities, availability, operating hours, locations, policies, photographs, and other offerings is accurate and not misleading.
If information changes, the responsible account holder should update it where platform functionality allows or contact Launch Point when assistance is required.
4. Acceptable Use and Intellectual Property
You agree not to misuse Launch Point or interfere with the ability of others to use it.
You may not use the website to violate applicable law; engage in fraud or deception; impersonate another person or business; harass, threaten, abuse, or unlawfully discriminate against others; distribute malware or malicious code; attempt to bypass website security; gain unauthorized access to accounts, servers, databases, or administrative areas; scrape or extract website data through abusive automated means; interfere with normal website operation; generate spam; manipulate ratings or reviews; submit unlawful content; or use the website for activities that could reasonably harm Launch Point, participating businesses, users, or other people.
You may not use automated bots, scripts, crawlers, extraction systems, or similar technologies to copy, harvest, republish, or commercially exploit substantial portions of Launch Point unless we have expressly authorized that use or it is otherwise permitted by applicable law.
The Launch Point name, logo, brand identity, website design, illustrations, graphics, interface elements, page layouts, original written materials, visual assets, and other content created or owned by Launch Point are protected by intellectual-property laws to the extent applicable.
Nothing in these Terms transfers ownership of Launch Point’s intellectual property to you.
You may access and use website content for ordinary personal travel research and legitimate use of Launch Point. You may not reproduce, sell, license, republish, distribute, modify, commercially exploit, or create unauthorized derivative uses of Launch Point -owned content except where you have received permission or applicable law permits the activity.
Third-party business names, photographs, logos, descriptions, trademarks, and other materials displayed through the website may belong to their respective owners. Their appearance on Launch Point does not transfer those rights to Launch Point or to website users.
If you believe content appearing on Launch Point infringes your copyright or other intellectual-property rights, you may contact us at info@launchpoint.travel with enough information for us to identify and evaluate the material concerned.
For online platforms seeking the liability protections available under the DMCA’s service-provider framework, the U.S. Copyright Office explains that qualifying providers must satisfy applicable requirements, and providers that designate a DMCA agent do so through the Copyright Office’s registration system. Nothing in these Terms represents that the general contact email listed above is a formally registered DMCA agent unless Launch Point has separately completed the required designation.
5. Availability, Disclaimers and Limitation of Liability
We work to maintain a useful, reliable, and accessible platform, but Launch Point is provided on an “as available” basis.
We do not guarantee uninterrupted access, continuous availability, error-free operation, compatibility with every device or browser, permanent preservation of every account or contribution, or that every feature will remain unchanged.
The website may occasionally be unavailable because of maintenance, updates, hosting issues, security events, software problems, third-party outages, technical failures, or circumstances beyond our reasonable control.
To the maximum extent permitted by applicable law, Launch Point makes no guarantee regarding the completeness, accuracy, reliability, availability, safety, suitability, or results of information, recommendations, listings, User Content, third-party offerings, or travel-planning resources displayed on the website.
You are responsible for making your own travel decisions and for verifying information that is important to your safety, finances, reservations, transportation, accommodation, schedule, or other travel arrangements.
Launch Point is not responsible for the acts, omissions, representations, products, food, facilities, vehicles, equipment, accommodations, guides, employees, contractors, safety procedures, cancellations, delays, injuries, property damage, service quality, or other conduct of independent businesses or third-party providers merely because information about them appears on or is accessible through Launch Point.
Where a transaction, booking, reservation, purchase, or service agreement is made directly between you and an independent provider, disputes concerning that provider’s performance should generally be addressed with that provider, subject to any rights you have under applicable law.
To the maximum extent permitted by applicable law, Launch Point will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use or inability to use the website, reliance on website information, loss of data, interruption of service, User Content, third-party services, or travel decisions made using information available through the platform.
Nothing in these Terms excludes, limits, or waives liability, obligations, warranties, guarantees, or consumer rights that cannot lawfully be excluded or limited.
The presence of disclaimers in these Terms does not permit Launch Point or any participating business to engage in deceptive practices. Alaska’s Department of Law identifies AS 45.50.471 as part of Alaska’s consumer-protection framework.
6. Suspension, Termination, Indemnification and Changes to the Platform
You may stop using Launch Point at any time. Where account-management functionality is available, you may use it to manage your account or request assistance from us regarding account closure or personal information.
Launch Point may restrict, suspend, remove, or terminate an account or access to particular features when we reasonably believe that a user has materially violated these Terms, engaged in fraudulent or harmful activity, compromised platform security, misrepresented a business, infringed another person’s rights, abused community features, manipulated reviews, repeatedly submitted prohibited content, or created a significant risk to Launch Point or its users.
Where reasonable and appropriate, we may provide notice or an opportunity to resolve an issue before taking permanent action. However, immediate action may be taken when reasonably necessary for security, legal compliance, fraud prevention, protection of users, or prevention of ongoing harm.
Removing an account does not necessarily require immediate removal of every record associated with that account. Certain information may be retained where reasonably necessary for legal compliance, security, fraud prevention, dispute resolution, backup processes, recordkeeping, enforcement of these Terms, or other purposes described in our Privacy Policy.
Public content may also have been copied, indexed, shared, or otherwise made available by third parties before its removal from Launch Point.
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, costs, or expenses arising from your unlawful use of Launch Point, your material violation of these Terms, your infringement of another person’s rights, or User Content or business information you submit without the necessary authority or rights.
This obligation is not intended to make an ordinary user responsible for conduct caused solely by Launch Point or for liabilities that cannot legally be transferred.
Launch Point may add, remove, redesign, improve, or modify website features over time. This can include changes to accounts, profiles, the Adventure Builder, itinerary features, Travel Journals, favorites, business listings, excursions, restaurants, accommodations, comments, reviews, search tools, filters, community functionality, and other services.
We may also update these Terms when our services, technology, business practices, or applicable requirements change. The updated Terms will be posted on the website with a revised “Last Updated” date.
If a change materially affects users’ rights or obligations, we may provide additional notice where appropriate or legally required. Continued use of Launch Point after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
7. ASSUMPTION OF RISK, WAIVER, AND RELEASE — OUTDOOR RECREATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND LIMITS OUR LIABILITY. DO NOT USE THE PLATFORM TO PLAN OR UNDERTAKE OUTDOOR ACTIVITY IF YOU DO NOT AGREE TO IT.
7.1 Acknowledgment of Inherent Risk
You acknowledge that outdoor recreation and travel activities are inherently dangerous and that participation may result in property damage, financial loss, illness, injury, permanent disability, paralysis, and death.
These activities include, without limitation: hiking, backpacking, trail running, mountaineering, climbing, scrambling, glacier and icefield travel, skiing, snowboarding, snowmachining, snowshoeing, avalanche terrain travel, fishing, sport fishing charters, clamming, hunting, boating, kayaking, packrafting, paddleboarding, rafting, sailing, water taxi and charter travel, surfing, swimming, tidal-zone activity, beachcombing, wildlife and bear viewing, birding, photography in remote areas, flightseeing, bush plane and helicopter travel, ATV and off-road travel, cycling and bikepacking, camping, remote and backcountry travel, winter travel, cabin and hut travel, foraging, and any related travel to or from these activities.
Inherent risks include, without limitation: rapidly changing and severe weather; hypothermia, frostbite, and heat illness; cold water immersion and drowning; extreme tidal ranges, tidal flats, mudflats, and rip currents; avalanche, cornice failure, crevasse fall, icefall, rockfall, and landslide; unstable snow, ice, and terrain; falls from height; difficult, unmarked, unmaintained, eroded, or nonexistent trails; navigational error and becoming lost; river and creek crossings; wildlife encounters including bears, moose, wolves, and marine mammals; insects and disease; contaminated water; toxic or misidentified plants, berries, and shellfish, including paralytic shellfish poisoning; volcanic and seismic activity; wildfire and smoke; equipment failure, misuse, or inadequacy; vessel, aircraft, and vehicle accidents; the negligence, error, inexperience, impairment, misconduct, or criminal acts of guides, operators, other participants, and third parties; physical exertion beyond your capacity; aggravation of pre-existing conditions; limited or no cellular, satellite, or radio communication; and delayed, limited, difficult, or unavailable rescue, evacuation, and emergency medical care due to remoteness, weather, darkness, or resource constraints.
7.2 Express Assumption of Risk
You knowingly, voluntarily, and expressly assume all risks — known and unknown, foreseen and unforeseen — of any activity you undertake, plan, research, or consider using the Platform, whether or not those risks are described above.
You are solely responsible for evaluating whether any activity is appropriate for you and for every member of your party, taking into account health, medical conditions, fitness, skill, training, experience, judgment, equipment, clothing, food and water, navigation and communication tools, group dynamics, current conditions, forecasts, permits, regulations, and the qualifications and insurance of any provider.
You are solely responsible for your own safety and the safety of your party. No content on the Platform relieves you of that responsibility.
Alaska law addresses assumption of the inherent risks of sports and recreational activities. Nothing in this Section is intended to expand or contract any statutory allocation of risk under Alaska law.
7.3 Release and Waiver
To the maximum extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Launch Point and its owners, officers, directors, members, managers, employees, contractors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, demands, actions, causes of action, damages, losses, costs, liabilities, and expenses of any kind — including personal injury, illness, disability, death, emotional distress, property damage, and economic loss — arising out of or relating in any way to:
(a) your participation in, planning of, preparation for, or travel to or from any outdoor, recreational, travel, or other activity that you learned about, researched, planned, organized, booked, or were encouraged to undertake through the Platform;
(b) your reliance on any information, content, article, adventure description, itinerary, route, map, gear list, difficulty rating, suitability guidance, safety commentary, conditions report, review, rating, recommendation, chat message, group post, webcam image, advertisement, sponsored placement, email or newsletter, push notification, or social media post published on, distributed through, or associated with the Platform or any Launch Point social media account — whether authored by another user, by a business, by a third party, or by Launch Point itself, and whether the information was inaccurate, incomplete, outdated, mistaken, negligently prepared, omitted, or removed;
(c) the acts, omissions, negligence, misrepresentations, misconduct, breach, delay, cancellation, insolvency, uninsured status, unlicensed status, equipment, personnel, vehicles, vessels, aircraft, facilities, food, or services of any business, guide, operator, host, advertiser, transportation provider, accommodation provider, restaurant, or other third party listed on, promoted through, advertised by, recommended by, discovered via, or connected to the Platform — including any operator whose services you booked and paid for through the Platform, and including any operator we featured, ranked, recommended, or promoted, whether or not we received compensation for doing so;
(d) the acts or omissions of other users, including group organizers, moderators, contributors, reviewers, and persons you meet or coordinate with through the Platform, whether online or offline; and
(e) any decision you make, or decline to make, based in whole or in part on the Platform.
This release applies to claims based on negligence, including our own ordinary negligence, to the fullest extent the law allows.
7.4 Limits on This Release
This release does not apply to, and nothing in these Terms attempts to waive, limit, or disclaim:
- gross negligence, recklessness, willful or wanton misconduct, or intentional wrongdoing by Launch Point;
- fraud, fraudulent misrepresentation, or deceptive acts or practices, including under Alaska’s Unfair Trade Practices and Consumer Protection Act (AS 45.50.471 et seq.) or comparable law;
- liability for death or personal injury to the extent a release of such liability is prohibited by applicable law;
- any consumer right, statutory right, warranty, or remedy that cannot lawfully be waived, excluded, or limited.
If any portion of this Section is held unenforceable, the remainder will be enforced to the greatest extent permitted, and the unenforceable portion will be reformed or severed rather than voiding the Section as a whole.
7.5 Emergencies
Launch Point does not monitor for emergencies and does not provide, coordinate, dispatch, or summon emergency services. Do not use the Platform, chat rooms, groups, or messaging to report an emergency or request rescue. In an emergency, contact 911, the Alaska State Troopers, the U.S. Coast Guard, or the appropriate land management agency by the most direct means available. Carry appropriate emergency communication equipment, leave a trip plan with a responsible person, and do not depend on cellular coverage.
8. USER-GENERATED CONTENT AND THIRD-PARTY INFORMATION — NO VERIFICATION
The Platform is composed of content created by users, businesses, advertisers, public agencies, and other third parties. This includes articles, adventure write-ups, trail and route descriptions, gear and packing recommendations, difficulty assessments, suitability guidance (“best for,” “not recommended for”), safety commentary, reviews, ratings, comments, chat messages, group posts, business listings, excursion descriptions, menus, hours, pricing, photographs, videos, and itineraries.
We do not verify, fact-check, inspect, test, validate, or independently confirm any of it. We have no obligation to do so. Content may be inaccurate, incomplete, outdated, exaggerated, mistaken, misleading, biased, unsafe, or fabricated. All content is for entertainment purposes only.
Recommendations about routes, gear, conditions, difficulty, timing, water crossings, wildlife, weather, avalanche or ice conditions, tides, navigation, physical fitness requirements, or the suitability of an activity for any person or group reflect only the opinion of the individual who posted them. That person may have no relevant training, certification, or expertise, and may be wrong.
Conditions change rapidly and without notice. Trail, road, water, ice, snow, tide, weather, wildlife, fire, closure, permitting, and access conditions can change within hours. Any description of conditions on the Platform reflects, at best, a moment in the past. It is not a current conditions report.
You must independently verify all information that matters to your safety, finances, schedule, or travel arrangements directly with the relevant business, operator, land manager, park authority, harbormaster, transportation provider, weather service, or other responsible party before you rely on it.
Nothing on the Platform — including featured placements, staff picks, editorial selections, “popular,” “recommended,” “trending,” or similarly labeled content, ratings, review scores, or search ranking — constitutes an endorsement, certification, or representation by us regarding the quality, safety, legality, licensing, insurance, competence, availability, or suitability of any business, person, activity, route, or piece of information.
9. YOUR REPRESENTATIONS AND RESPONSIBILITIES FOR CONTENT
You are solely responsible for all User Content you submit. By submitting User Content, you represent, warrant, and covenant that, to the best of your knowledge and belief after reasonable diligence:
- You own it or have all necessary rights, licenses, consents, and releases to submit it and to grant the licenses in Section 9;
- It is truthful and accurate in all material respects, and not misleading, deceptive, or presented in a way that creates a false impression;
- It is not defamatory, libelous, slanderous, or trade-disparaging, and does not make false statements of fact about any person or business;
- It does not infringe or misappropriate any copyright, trademark, patent, trade secret, right of publicity, right of privacy, moral right, contractual right, or other right of any person or entity;
- It does not violate any law, regulation, or ordinance, including consumer protection, advertising, securities, gambling, controlled substance, firearms, wildlife, land use, and permitting laws;
- It is not discriminatory, harassing, hateful, or abusive, and does not attack, demean, threaten, or advocate exclusion or violence against any person or group on the basis of race, color, national origin, ethnicity, religion, sex, gender, gender identity or expression, sexual orientation, age, disability, veteran status, or any other protected characteristic;
- It does not contain threats, incitement to violence, doxxing or personal information about others, sexual content involving minors, non-consensual intimate imagery, malware, or content promoting self-harm;
- It does not violate any third party’s privacy, and any identifiable person depicted has consented to that depiction and to its use under these Terms;
- It is not spam, and does not constitute undisclosed advertising, pyramid schemes, or deceptive commercial solicitation;
- It discloses any material connection you have to a business, product, or service you write about, as required by the Federal Trade Commission’s guidance on endorsements and testimonials; and
- If it is a review or rating, it reflects your genuine, first-hand experience and honest opinion.
9.1 Reviews, Ratings, and Reputation
Reviews and ratings must reflect genuine, actual experiences. You may not post fake, fabricated, incentivized-but-undisclosed, or AI-generated-as-if-genuine reviews; impersonate a real or fictional customer; post reviews about your own business, a competitor, an employer, a family member’s business, or a business you have a financial interest in without clear disclosure; buy, sell, exchange, or solicit reviews for compensation; suppress negative reviews through threats, intimidation, or unfounded legal demands; or otherwise manipulate ratings, rankings, votes, or reputation metrics.
The Federal Trade Commission’s Rule on the Use of Consumer Reviews and Testimonials prohibits specified deceptive conduct involving consumer reviews and testimonials, including fake and false reviews, insider reviews without disclosure, buying positive or negative reviews, and certain review suppression. Violations can carry civil penalties against the person or business responsible. You, not Launch Point, bear responsibility for your compliance.
9.2 Our Rights Regarding Content
We may, but are under no obligation to, review, screen, moderate, edit, refuse, restrict, label, demote, hide, remove, or preserve any User Content, and to suspend or terminate accounts, for any reason or no reason, with or without notice. Our decision to act, or not to act, in any instance creates no duty, standard, or expectation with respect to any other instance.
We do not endorse, adopt, verify, or vouch for any User Content. A business’s disagreement with a negative review does not, by itself, entitle it to removal. Publication of content does not mean we have verified it.
We may retain removed content as reasonably necessary for legal, safety, security, enforcement, and dispute-resolution purposes.
10. ACCEPTABLE USE
You may not, and may not permit anyone else to:
-use the Platform in any manner that could reasonably harm Launch Point, its users, or participating businesses.
-violate any law, regulation, or these Terms;
-engage in fraud, deception, impersonation, or misrepresentation;
-harass, stalk, threaten, bully, defame, or discriminate against any person;
-post unlawful, infringing, obscene, or harmful content;
-collect, harvest, or scrape data about users, businesses, or listings, whether manually or by bot, crawler, scraper, or automated means, except as we expressly authorize in writing or as applicable law permits;
-use Platform data to train machine learning or artificial intelligence models without our express written permission;
-reverse engineer, decompile, or attempt to derive source code;
-circumvent security, rate limits, access controls, paywalls, or moderation systems;
-gain or attempt to gain unauthorized access to accounts, servers, or systems;
-distribute malware, spam, or unsolicited commercial messages;
-interfere with the operation, performance, or integrity of the Platform;
-manipulate reviews, ratings, rankings, engagement, or visibility;
-resell, sublicense, or commercially exploit the Platform or its content without authorization; or
11. INDEMNIFICATION
11.1 By All Users
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Launch Point and the Released Parties from and against any claims, demands, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your User Content; (b) your breach of these Terms or your representations in Section 10; (c) your violation of any law or any third party’s rights, including intellectual property, privacy, and publicity rights; (d) your use or misuse of the Platform; (e) your interactions with other users, online or offline; and (f) any activity you undertake in reliance on the Platform.
This obligation does not extend to claims caused solely by Launch Point’s own gross negligence, recklessness, or willful misconduct, nor to liabilities that cannot lawfully be shifted to a consumer.
11.2 By Businesses and Advertisers
If you use the Platform as a business, advertiser, guide, operator, or other commercial user, your indemnification obligation additionally extends to any claim arising from your listing content and marketing claims; your goods, services, excursions, food, lodging, transportation, or activities; injury, illness, or death occurring in connection with your operations; your failure to hold or maintain required licenses, permits, or insurance; your failure to obtain a signed participant waiver; your employees, contractors, vessels, aircraft, vehicles, and equipment; your cancellation, refund, and booking practices; your compliance with consumer protection, advertising, and review-related law; and your handling of customer data.
Your indemnification obligation additionally covers all payment-related exposure arising from your services, including chargebacks, refunds, reversals, network fines and assessments, processor penalties, funds we return to travelers because you cancelled or failed to perform, amounts we are required to refund by a card network or by law, and our costs of collection. You authorize us to satisfy these amounts by offset against payouts owed to you and against any reserve we hold.
Nothing herein 12 shifts responsibility for your services to Launch Point. Our collection of traveler funds on your behalf does not make us liable for your performance, and you will not represent to any traveler, insurer, regulator, or court that it does.
Commercial users are not entitled to the consumer-protective carve-out in Section 16.1 except to the extent required by law.
12. Governing Law, General Terms and Contact Information
These Terms and your use of Launch Point are governed by the laws applicable in the State of Alaska and applicable federal law of the United States, without giving effect to conflict-of-law principles to the extent legally permitted.
Nothing in these Terms prevents a user from exercising rights or protections that applicable consumer law requires to be available regardless of contractual choice-of-law provisions.
If a disagreement occurs between you and Launch Point, we encourage you to contact us first so that we have an opportunity to understand and attempt to resolve the issue.
Nothing in these Terms requires you to give up a legal right or remedy that cannot lawfully be waived.
If any provision of these Terms is determined by a court or other authority with appropriate jurisdiction to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent reasonably necessary, and the remaining provisions will continue in effect to the extent permitted by law.
Our failure to immediately enforce a provision of these Terms does not automatically waive our right to enforce that provision later.
These Terms, together with the Privacy Policy and any additional policies or terms expressly presented for a particular website feature, constitute the applicable agreement concerning use of Launch Point. Where special terms are presented for a particular transaction, booking feature, business service, or other functionality, those special terms may supplement these Terms.
